- Phillip runs after her.

THE PARK: Marah, Shayne and Tammy are playing - Shayne is calling Tammy a
baby as Hart walks up and pulls Shayne aside. Hart talks briefly to Shayne -
then asks Marah who the other girl is. Marah introduces Tammy and Hart tells
Tammy he knows her mother. Tammy wants to know how, as Cassie walks up and
says (with a smile) not to ask so many questions.

COURTHOUSE: Dinah tells the cameramen to take a break and snatches her
microphone back from Van. Michael goes inside the courtroom, and Van talks
to Dinah about how she's covering the case on WSPR and how it's hurting Ross
and people they love.

Inside: Rick tells Jesse to get him a gun right away. Jesse is stunned.

LIGHTHOUSE TWIRL

Jesse tries to convince Rick a gun is wrong - any weapon available could be
used and used by the wrong person. Michelle comes up and tells Rick to go
talk to Abby. Blake tells Ross he's doing a good job and he looks reassured
momentarily. The judge asks if Ross has any more witnesses and he rests his
case. The judge says she will grant an adjournment but Ben doesn't want it.
Ben says he wants an immediate dismissal. Everyone in the courtroom is shocked.

COURTHOUSE HALL: Van tells Dinah she understands how badly things are going
with Hart - Dinah interrupts that she can still do her job - and the ratings
prove it. Van tells Dinah she's putting the ratings first and Dinah denies
it. Van is just trying to keep Dinah from alienating people - Dinah thinks
she has to do things Van's way or get sent off to the carnival - something
Van's new baby won't have to worry about. Van gives Dinah a look and heads
into the courtroom; Dinah is about to stop Van when the WSPR camera guy
comes back. Dinah goes back to work.

Inside, the judge dismisses the jury so she can deliberate. Van wants to
know what's going on and Holly tells her about the request for dismissal.
Ben argues that Abby's testimony should be dismissed because her
identification of Roy was forced by Jesse - Ben then recounts the events
leading up to Roy's arrest. Ross is clearly agitated; Jesse tells Michelle
that Roy will get off and it will be all his fault.

PARK: The kids run up to Cassie and Hart; Cassie says it's time to go home
but they want to stay and play - Cassie says they can play a while longer.
Cassie and Hart sit - Cassie is still a bit worried about what Annie and
Alan will do - then they start to talk and laugh about Tammy and Peter and
how great children are. Cassie says how great Josh and Billy have been. Hart
admits that he overheard Cassie's conversation with Billy.

SPAULDING ENTERPRISES: Harley tries to explain that she misunderstood and
won't let Phillip get a word in edgewise - which he comments on. Harley
understands that Phillip is divorced and needs to be careful about what he
presents to his daughter. Harley goes on that when Phillip brings Lizzie
over for Thanksgiving they should maintain some distance - so Lizzie won't
be uncomfortable - Phillip doesn't think Lizzie will be upset with the woman
he loves. Harley is surprised and asks him to repeat - Phillip does and they
kiss.

THE PARK: Cassie is trying to figure out why Hart overheard her conversation
with Billy. Hart says he was worried about her - then Cassie wonders how the
whole thing affected Dinah. Hart tries to play it down - Cassie says she
doesn't really care if Dinah is jealous, but she's worried about Hart - it's
the holdidays so they'll work everything out. Hart says there are no
holidays in store for him and Dinah. Cassie realizes the breakup is real -
not just a spat - and worries about Hart being alone.

COURTROOM: Ross protests the dismissal - saying that if Abby saw Roy in a
mall the result would have been the same - and identification. Ben pipes up;
the judge tells Ben to be quiet and Ross asks Ben to continue - because he
doesn't understand. Ben and Ross go at it some more. The judge quiets them
both and decides to consider Ben's motion and adjourns. Jesse thinks it's
his fault, Michelle and Abby disagree. Rick tries to calm Abby. As Abby is
leaving the courtroom she sees Reva - Reva tells her to have faith. In the
hallway, Dinah shoves the microphone in Abby's face and Reva tells Dinah to
back off. Dinah looks annoyed.

Back inside the courtroom - Roger arrives and Blake waves him over. Blake
tells Rog that she needs him to get rid of Ben Warren right now.

HALFTIME

Roger is incredulous - Blake tells Rog that Ben is out to destroy Ross.
Roger thinks that Ross can handle things himself. Blake ups the ante and
swears Roger to secrecy - then tells him that Ben is Ross' half brother.
Roger is somewhat amazed but still thinks Ross can handle it. Blake tells
Roger that Ben is after Ross' whole family - including her. Blake tells
Roger that Ben offered to drop Roy's case if Blake slept with him; then
Blake makes it sound as if Ben got HER to go to the hotel room. Roger is
incensed and tells Blake not to worry - he'll take care of everything. Blake
thanks Roger - Holly walks up and has obviously overheard the last part and
wants to know what Roger is going to "take care of".

Out in the hallway, Abby is worried; Michelle tries to comfort her and
offers to go get them something to eat. After Michelle walks away, Abby
takes the elevator out. Inside Roy decides to go out some air - Ben advises
Roy to take his mother - it will look better that way. Roy gets his mother
and postures briefly as he walks past Jesse and Rick. Ben goes to sit behind
Ross and taunts him - saying Ross would have done the same thing. Ross says
he's in the D.A.'s office because he believes in justice. Ben taunts some
more and Ross says he can't believe they have the same blood - Ben tells
Ross to think of what he was like 15 years ago.

THE PARK: Hart still can't believe Cassie is worried about him being alone.
Cassie reminds him of how hard it is to be alone on holidays - and that's
why she want's Tammy in her permanent custody. Hart doesn't think it's a
problem - and Cassie reminds him of how powerful Alan is. Hart tells Cassie
she has powerful new friends and all of Lewis legal backing her up. Cassie
feels blessed, and Hart thinks about how great he felt when his grandfather
was alive. Cassie is still worried that Hart will be alone at Thanksgiving -
then looks around for the kids. Cassie says she has to go back to the
courthouse to talk to Reva, and Hart offers to walk with her.

Roy and Ski walk up - Roy jokes that he got his mother to check the parking
meter. Ski jokes about Roy not being "upstate". Roy doesn't think it's funny
and says this case could be his life - Ski tells Roy he has nothing to
worry about - because of his great lawyer. Roy sees something out of the
corner of his eye and tells Ski he'll see him later. Abby walks into the
park and stops - not noticing Roy behind her.

SPAULDING ENTERPRISES: Phillip and Harley end their kiss - with Phillip
wondering why Harley looks surprised. Harley says she is surprised - she
can't believe the words - then runs up to Phillip and they kiss again.
Phillip says that he really wants Harley to like Lizzie and Harley says it's
no problem - she knows she will. They kiss some more and Phillip backs
Harley toward the desk and she bumps into a coffee cup which spills on her.
Harley wonders what she's going to do - and Phillip suggests washing it out
in the shower adjoining his office - they would still have enough time to
get to the airport. Harley wants to know why he isn't joining her since it's
fault about the spill - he says they wouldn't have enough time to get to the
airport is he joined her.

COURTROOM: Roger tells Holly that one of these days she will not assume the
worst about him. Holly tells him that will be the day she trips up. They
grin/sneer at each other, then Rog walks off. Holly walks up to Blake and
asks if Blake plans to "fill her in". Blake says Rog is right; Blake
proclaims that Rog always comes through for his family and one of these days
Holly would realize what a great attribute that is. Holly muses about how
she's hearing one of these days a lot lately. Blake reminds Holly that Rog's
motivation is his family and Holly says that she has no problem with Rog's
motivations - it's his actions. Blake half agrees and walks off. Fletch
walks up wondering is "Red" is having problems and she says nothing she
can't handle.

Out in the hall - Rog stops Ben - Ben thinks it's a reporter. Roger says he
has a message for Ben and Ben wants to know who Roger is - "someone who
doesn't play by the rules. You stay away from the Marlers - every single one
of them."

Back inside - Van is telling Michael about how she couldn't make any headway
with Dinah - and makes some noise about how she doesn't have any time left.
Michael doesn't get why Van is talking that way - then gets beeped and has
to leave for the hospital.

Jesse and Rick are waiting impatiently - and start to wonder where Abby is -
they ask Michelle and Reva - no one has seen her in a while.

THE PARK: Abby sits alone and tries to convince herself she did the right
thing. She looks down and sees a penny - which she think is good luck. As
she bends to pick it up Roy comes up and starts to taunt her about how it's
not her lucky day. Abby tries to walk away and Roy follows telling her to
look at him when he talks.

Roy sits her back down, telling Abby she only had to sit back and relax and
she wouldn't have ended up in the hospital. Abby talks back and Roy tells
her when he gets off he's going to find Abby and shut her up for good. Abby
runs away and Roy laughs.

COURTHOUSE HALL: Dinah is doing another broadcast - Ben comes out and she
asks him it's going - Ben says right will prevail. Dinah cuts and Ben asks
her about their evening - Dinah says he had his chance. The elevators open
and Cassie and Hart get off - Dinah sees them immediately. Rick comes up
asking if they saw Abby outside - they didn't - Rick asks Hart to help him
look and Hart agrees. Cassie walks toward the courtroom and Dinah stops her.
Dinah says she heard about Cassie being Reva's sister - and hoped Cassie
didn't think that would pull a lot of weight in town. Dinah taunts more
about drugging Hart and Josh and how Cassie would never get her child back.
Cassie tells Dinah she IS a child. Abby and Rick arrive back on the
elevator and Abby pretends to be fine. Roy arrives right behind them.

Inside - court is called back to session. The judge says she is ready with
her decision. Ben looks at Ross who looks concerned.

SPAULDING ENTERPRISES: Harley comes out of the shower wearing one of
Phillip's shirts - he tells her it's his favorite shirt and that she has to
give it back. They start to kiss when we hear "Daddy!" and Lizzie runs in.
Phillip is surprised and asked how she got there - Beth walks in saying that
Lizzie wanted to surprise Phillip so she got an earlier flight. Phillip and
Harley both looked stunned and Beth smiles.

COURTROOM: The judge explains that there is evidence that Roy attacked
Abby, but under the law she has to dismiss Abby's identification of Roy -
Rick and Holly shout. The judges quiets them and says that without the
identification, the state has no case and she has to dismiss the case. The
courtroom erupts: Roy and his friends start cheering - Dinah comes in with
cameras, Rick tries to get Abby out, then starts yelling at the judge. Frank
and a bailiff try to detain Rick. Roy's friends put him up on their
shoulders in victory. As Roy comes down - he looks at Abby and makes motion
across his throat and mouths "you're dead". Abby gasps and grabs the
bailiff's gun and shoots Roy.
